1. About these Terms
These Terms govern access to and use of traffiliate.io, including enquiries and communications submitted through it. “Traffiliate”, “we”, “us” and “our” refer to the Website operator. By using the Website, you agree to these Terms.
2. Eligibility
You must be at least 18 years old, legally capable of entering agreements and using the Website only for lawful business purposes.
3. Our business
Traffiliate provides business-to-business iGaming performance marketing and traffic services, which may include PPC, SEO, email, SMS, lead generation, media buying and audience acquisition. We do not operate a casino, accept wagers, hold player funds or provide gambling facilities.
4. No professional or gambling advice
Website content is general information and is not legal, financial, tax, investment or gambling advice. You are responsible for obtaining appropriate advice and assessing whether a campaign, market or opportunity is lawful and suitable.
5. Enquiries and commercial agreements
An enquiry does not create a contract, partnership, agency, exclusivity arrangement or obligation. A campaign or paid service begins only when the parties agree its scope, markets, traffic sources, pricing, payment, compliance and other conditions in writing. A separate written agreement controls the relevant service if it conflicts with these Website Terms.
6. Campaign availability and results
Traffic volumes, targeting, placements, timing, costs and performance may change. Unless guaranteed in a signed agreement, we do not promise a minimum number of impressions, clicks, registrations, first-time depositors, leads, conversions, revenue or return on investment. Forecasts and past performance do not guarantee future results.
7. Client responsibilities
Clients must provide accurate information, lawful creative materials, functional landing pages, tracking access and timely approvals. Clients must hold every licence, consent, permission and intellectual property right required for the promoted business, territories and materials, and must disclose compliance restrictions and material offer changes.
8. iGaming and marketing compliance
You must not request targeting where the promoted activity is unlawful or unauthorised. Campaigns must not target minors or self-excluded persons, make misleading claims, hide material conditions, encourage harmful gambling or breach advertising, privacy, direct marketing, consumer protection, licensing or responsible gambling rules. We may reject, pause or stop activity that creates legal, regulatory, security, consumer harm or reputational risk.
9. Acceptable use
You must not use the Website unlawfully or fraudulently; attempt unauthorised access; introduce malicious code; disrupt the Website; impersonate another person; submit false or infringing material; bypass security controls; or commercially exploit Website content without permission.
10. Traffic quality, tracking and reporting
Tracking may depend on third-party platforms, cookies, pixels, postbacks and client data. Reporting differences can arise from attribution windows, consent choices, fraud filtering and technical limits. We may exclude traffic reasonably identified as invalid, automated, duplicated, misleadingly sourced or non-compliant. The applicable agreement must define measurement and reconciliation.
11. Fees, invoicing and taxes
Website content alone creates no payment right or purchase obligation. Fees, currency, deposits, invoices, deadlines, refunds, chargebacks, commissions and reconciliation rules are stated in the applicable written agreement. Each party is responsible for its taxes unless law or the agreement requires otherwise. We may suspend delivery when an undisputed payment is overdue.
12. Third-party services
Third-party links and platforms are governed by their own terms, privacy notices, availability and security practices. We do not control every third party and are not responsible for third-party content or loss caused solely by a service outside our reasonable control.
13. Intellectual property and submitted materials
The Traffiliate name, Website design and original content belong to us or our licensors. You may view and fairly link to public pages but may not reproduce, modify, distribute, license or exploit our content or branding without permission. You retain ownership of submitted materials and grant us a limited right to use them to respond to an enquiry, assess a relationship or perform an agreed service. You confirm that you may provide those materials.
14. Privacy and communications
Our Privacy Policy explains how we handle personal information. We may respond using the contact details provided. Marketing email or SMS activity must comply with applicable consent, opt-out, suppression-list and privacy requirements.
15. Availability and security
We take reasonable steps to maintain the Website but do not guarantee uninterrupted, error-free or completely secure access. We may modify, restrict, suspend or discontinue parts of it for maintenance, security, operational or legal reasons.
16. Disclaimers
To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement where lawful. Nothing limits rights that cannot legally be excluded.
17. Limitation of liability
To the fullest extent permitted by law, Traffiliate is not liable for indirect, incidental, special, punitive or consequential loss, or loss of profit, revenue, business, opportunity, goodwill or data arising from use of the Website. A separate agreement sets liability for paid campaigns. Nothing excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or liability that cannot lawfully be excluded.
18. Indemnity
To the extent permitted by law, you agree to reimburse us for reasonable losses, liabilities, claims and costs arising from unlawful Website use, breach of these Terms or submitted materials that infringe another person’s rights. This does not apply to loss caused by our wrongdoing.
19. Suspension and termination
We may restrict or terminate access where reasonably necessary to protect the Website, users, third parties or our legal and commercial interests. Provisions concerning intellectual property, disclaimers, liability, indemnity and disputes survive where their nature requires it.
20. Governing law and disputes
A paid service agreement states its governing law and forum. For Website-only disputes with no separate agreement, the law and courts having lawful jurisdiction over the Website operator apply, subject to mandatory rights. The parties should first try in good faith to resolve the issue in writing.
21. Changes and general provisions
We may update these Terms when the Website, services or legal requirements change. If a provision is invalid or unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver.
